When Is A Guardianship Appropriate?

It may be necessary and appropriate to appoint a guardian ad litem or a guardian to assist a client through the legal process when the client:

  • Cannot understand legal proceedings
  • Cannot make critical decisions
  • Cannot communicate with counsel
  • Cannot weigh counsel's advice

A guardianship can assist a client in a case in several ways:

  • Explain the legal proceedings
  • Advise the court regarding the areas where the client struggles and help define the assistance that the client needs
  • Request the court to appoint a Conservator to manage the client's financial affairs
  • Ask the court to appoint a Guardian who can step into the client's shoes and make decisions on behalf of the client
