Children are often caught in the middle of divorce disputes. Yet their needs and desires are too often lost in the wake of each parent's belief they he or she is fighting for what is in their children's best interest. Colorado has several options to specifically address the needs of families involved in a divorce. One of the best options for protecting the interests of a child is having the court appoint a Child and Family Investigator (CFI), formerly called a Special Advocate.

Skilled Denver Child and Family Investigators

David Littman and Joshua Wohl have considerable, excellent experience serving as child advocates to ensure that the interests of children are protected in divorce actions. A Child and Family Investigator is appointed for the child by the court and reports directly to the court on the child's best interests. On July 1, 2005, the Colorado General Assembly changed the title from Special Advocate to Child and Family Investigator. Our attorneys have special training in child development and mental health. We are appointed either by agreement of the parties or court Order as soon as it becomes evident that parents cannot agree on parenting issues. In the role of Child and Family Investigator, we write a report to the court and can also be called as a witness at a hearing. We can also act as advisors in collaborative divorce situations if needed. 

Serving as a Child Legal Representative

While it is less common, a child may have an attorney appointed as their Legal Representative. The Child Legal Representative acts in the child's best interests, just as the parents' attorneys are acting for them. Providing this type of representation for the child gives the child ownership in the process and ensures their needs are appropriately considered. A Child Legal Representative may be appointed when there are significant financial issues concerning children in a divorce action. These issues may involve the management of a trust, the extension of child support beyond age nineteen for a disabled child and other matters requiring an experienced legal advocate.

Developing Parenting Plans for Young Children

While all parenting plans are difficult to develop as they involve the balancing of a multitude of factors, parenting plans for infants and toddlers are particularly complex. As attorneys and Child and Family Investigators, as well as Mediators and Arbitrators, we are current in the latest literature concerning this area. Many factors influence the creation of a parenting plan, including the history of parenting, the competence of each parent, the availability of each parent, the ability to support the child's relationship with the other parent, the ability to be child centered and other factors.
